Are you in consulting business. Technically you are supposed to work at the location where you have filed your LC. If you had filed prior to PERM, then you may be fortunate because pre-PREM there was a textarea where the employer could explain about where the beneficary would work. Consulting firms filled out this column in such a way that you could work anywhere in US, but your head office is xxxx. If this is the case then you should not have problems other than filling our AR-11 and sending it to DHS / USCIS.
If it is after PERM, then you do not have any options. I am not sure how consuting firms handle this situation.

Greetings all,
I am new to Immigration voice and feel very blessed for finding the site.
Here is my situation I am a green card holder since 1996. However I waited until now because I had I received probation before judgment in 2003. The case was expunged in 2007. The conviction was Annotated Code of Maryland article 27 , section 146 (c )(1 ) stipulating that : Any person who violates any provision of subsection (c)(1) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 3 years or both.
According to the information I found on USCIS, you can not have any conviction in the five years preceding your application; It looks like I should be fine. I am ready to apply now and it has been a good obedient green card holder for 6 years now, I don't have any issue with the law since 2003.
I am also married to a US citizen and have three children (all citizens). I was able to get all my information from the court prior to the expungement as well.
Please let me know what you think. Thanks you so much.

Hi All,

I accepted offer from employer B on Nov 20.I came in communication with employer B lawyers on Nov 23.I am based in one state and work
in another state.Lawyer got all the documents from me on Nov 25,Then she said , we will have to get prevailing wages from two states , and she
send the request for them.We received prevailing wages from states on Dec 11.Then she sent my H1b transfer petetion to USCIS on Dec 14.I received
the receipt from USCIS on Dec 18.
Will my H1b get transferred , or will I have any issues.

I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???

Hi All,
First of all Congrats! to all people who are eligible to file 485 in july..
i have strage problem..i am not weather its a problem or not..i have filed my GC in 2004 December and you all know that after that the BEC process came in every thing went to BEC's..and i had no hope on that file and i asked my employer to process my GC under PERM process in 2006 april and i got the Labor and I-140 approved in 6 months...and mean while i got the 2004 labor approved in Feb 2007 and asked my employer which one will be the best and he recommended me apply for I-140 for 2004 labor and wait untill the dates become current and he was expecting the 2004 will become current...so we have applied for I-140 for 2004 labor on May 1st 2007 and the status is pending...now my questios is..
1) Is there is any problem if i use the 2004 labor and apply for I-485.
2) When attorney file for I-140 did they mention any where in that forms that i do not have any immigration petiton has been submited before?
3) If they mention no (miss communication) and applied for I-140 for 2004 labor but in fact there is a petition (I-140) submited for me for my 2006 labor.will this be a problem for my 485 approval?
4) which one will be the best for me to use now 2004 or 2006?

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

I suppose it depends on how you plan on using your next camera body.
For me, I bought a second D100 body (I shoot weddings professionally) even though I could have bought a D70, a used D1X or even waited for the D2X or the fabled D200.
Why? Well, in my case, I wanted a backup camera that could be used as a second camera at the same time. Not having to think about the differences in controls and settings when switching from camera A to camera B made buying a second D100 an easy choice. Plus, I bought the second D100 used for $825. It was in mint condition although it had over 11,000 actuations on it. A new D100 right now is running around $1100 after rebate, so that's not bad either!
If you want to be able to swap cameras without a second learning curve, get another D100. If you want something totally different (but not quite) get a D70. Or, just wait and see if Nikon will come out with the replacement for the D100. But you could be waiting for a while! :)

It is very unikely that the US consulate in London will accept your visa application unless you have close ties to the UK. You will probably need to apply in India, or consider Canada or Mexico.

Even though your end client is not the direct client for your employer, they might have used the laguage in the non-compete which reflects the scenario. So check your non-compete document.
May be the final verdict is in favour, you need to take so much of pain in the whole processes. If you prepare for these upfront you can go a head and fight. I had seen couple of instances in the NY, with my friends, where non-compete became VOID.

I am applying 485 for me and my wife.My wife got H1 in Oct 2006 but she didnt work until now So she dont have any paystubs.So my attroney suggested to do it on H4 but her H1 is to be collapsed for that she is planning to go canada (not for stamping)and come back so that her H 1 will be collapsed and H4 will be there.I came to know from my friends that canada people are not givng any I 94 for visitors who travle by road.If we request for I 94 they are asking to keep the same I 94 which we have in our respective document.I just want to know how to get the new I 94 for her?
And also Please suggest If there is any way to apply for 485 without cancelling her H1.

Applying for I-485 is not a problem.Problem is only if your your wife gets caught for not having paystubs(that means not maintaining legal status).If your wife having a valid visa stamping , she can travel outside US(may be india) and re enter into US which clears her previous illegal status.Let us know if you find more info.

Requiring experience in addition to MS degree is considered "normal" for positions in Job Zone V. Whether it's more likely to trigger an audit or not - I doubt anybody will be able to tell you. For that somebody has to have experience of filing two PERMS, almost identical except for the experience requirement. I doubt many people have such an experience
