Slightly sooner than expected but the H1B cap was reached today. U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2011. USCIS is notifying the public that yesterday, Jan. 26, 2011, is the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY2011.
The final receipt date is the date on which USCIS determines that it has received enough cap- subject petitions to reach the limit of 65,000. Properly filed cases will be considered received on the date that USCIS physically receives the petition; not the date that the petition was postmarked. USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY2011 that arrive after Jan. 26, 2011.
USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap and were received on Jan. 26, 2011. USCIS will use this process to select petitions needed to meet the cap. USCIS will reject all remaining cap-subject petitions not randomly selected and will return the accompanying fee.
On Dec. 22, 2010, USCIS had also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the �advanced degree� exemption. USCIS will continue to accept and process petitions that are otherwise exempt from the cap.
Those who missed the filing this week, should get ready to file on April 1, 2011 for the FY 2012 term, we feel that visas will run out fast this coming April.

NetIP is a nationwide organization, though each chapter seems to function in a somewhat independent way. However, events that have been successful at one chapter tend to be taken up by other chapters.
The nationwide NetIP chairs did not respond to me, though the Bay Area president did.
Here is a list of chapters. There is a tri-state chapter.

It sounds like your employer substituted you on an already approved labor cert. The original LC was approved before PERM came into effect, which is why they used the old forms. When doing an LC substitution, the employer kept the original approved Part A and the new, substituted employee needed to complete the Part B.

It does not say that H1B workers lack any courage and will power to stand up for themselves. They lack unity, are narrow minded and cannot work together. Their high education works in their disadvantage because they use to fight within themselves. Looks like there is a huge backlog of perm applications. I am not sure if they will look at your application anytime soon. If your application is pending more than a year at least you could apply for extension of H1.
It will be delusional on our part to think that perm applications will have an easy approvals.

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

You do not need new visas. At port of entry show the new approval notice to get I-94 for the duration of the new approval notice.
My husband is in H1B visa and he transfered his visa to another company. Got the I-797 approvals too. Along with that mine and my kids H4 also got approved.
Now I am urgently required to travel to India, and want to return from India without going for stamping. Here are other details.
1) Even my previous H4 visa is not expired while I return from India.
2) I have the new H4 approval notices and copy of husbands new H1s I797 with me.
Will it be an issue if I reenter without stamping. Our plan is to go for Visa stamping to any nearby consulate in US border after I come back. Please advise.

So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?
I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.
