Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. I am on H1B working as a consultant for a Client company.
My Project is ending this month. I filed my 485, EAD on March 2009 on EB2 Row and PD 2008 Jan through my parent Company.
140 approved long time back.
485 is < 180 days. EAD not yet approved.
I fear potential layoff in case not found a project fast.
Can I know my options. ?
Please reply...any experts..

so far i've been the ones to pay everything...i know govt got stricter this year and now it HAS to be employer who pays....so i'm in bad place as I know how my employer is...

Very few members are intrested in discussing H1B as most IV members are on EAD.
Thats not true. There are equal number of people who have EAD and still keep their H1 for some reason.

All,
My PD is 11/2003 and my case was transfered to PA backlog center, I have not heard anything since then.
My employer wants to call the Senators and Congressmen to see if they can expedite this process.
Could you please provide some suggestions on:
1. What should the employer tell to the law makers?
2.How will the law makers help me?
3. Do you have any fax/email templates?
4. Any other suggestions?
Thank you all for your help.

U.S. Citizenship and Immigration Services (USCIS) announced today that it will begin accepting H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) subject to the fiscal year (FY) 2011 cap on April 1, 2010. Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.
The fiscal year cap (numerical limitation on H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)) for FY 2011 is 65,000. Additionally, the first 20,000 H-1B petitions filed on behalf of individuals who have earned a U.S. master�s degree or higher are exempt from the H-1B cap.
USCIS will monitor the number of petitions received and will notify the public of the date on which USCIS received the necessary number of petitions to meet the H-1B cap. If needed, USCIS will randomly select the number of petitions required to reach the numerical limit from the petitions received on the final receipt date. USCIS will reject cap-subject petitions that are not selected, as well as those received after the final receipt date.
We recommend employers to hurry up and get all the necessary documents in order to meet the April 1, 2010 deadline.

I moved from Company A to company B towards the end of my H1 6 th year with only a month and half left in my H1. Company B applied for my 140 and 140 was approved just on the day of my 6 year completion. H1 transfer was filed in parallel in normal processing. H1 transfer has got an RFE now a day after 140 was approved.
1. Will there be any problems in getting the H1 transfer based on the 140 approval with the new company? Please note that I do not have any days left in my original H1.
2. What will the duration of H1 if the transfer gets approved?
3. I am continuing to work based on 140 approval and pending h1 transfer. Please advice is it is ok.

My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

Hi Friends,
Thanks so much for your help. I had a question for my friend. He is on H1B status with wife on H4 status. Both expiring Sept 30 2008 (First three years). They applied for regular extension in July 2008 (for both his H1B extension and her H4 extension). Application is pending. Question is will her H4 status be affected if she leaves the country before approval of her extension? Lets say she leaves the country in October 2008 before their extension is approved would that cause any problems? She would plan to come back mainly once his extension is approved as she would need to take his approval in any case to Mumbai Consulate for H4 stamping. But the question is would her leaving the country cause any problems? and can she just use his approval once it comes to get her H4 visa stamped and then come back? Or do they have to go for premium processing for their current apps to avoid any issues? Thank you so much.

This is the wording i saw at the embassy site:-
"Foreign-born minor children are not eligible for OCI if both the parents are Indian citizens holding Indian Passports."
So its clear that if both parents are indian citizens with indian passports the kid cannot get an OCI and has to get the PIO instead.
