Hi ,
I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.

The Majority consisting of conservative justices---- Alito, Roberts, Scalia, Thomas, and Kennedy based their decision on the history of the second Amendment, where militias were given the right to protect their farmlands. At that time we had no organized police force, we had no justice system in place.
Who are the militias of today? The KKK-- the uneducated people, who generally do not work, collect welfare checks, and blame all their owes on the colored people and now the "illegal immigrants."
If the Supreme Court grants the right to local levels to enact gun controls, one can only speculate for instance what kind of gun control laws Maricopa COunty in Arizona will enact.
Due Process protects every "individual"; it does not say "citizens". And just like every individual has the right to protect themselves with weapons, every individuals also have the more fundamental right to live.
Although the justices said that the Second Amendment allows for a reasonable restriction of guns, their rationale based on history of the second Amendment gives the militias a carte blanche right to bear arms. This can indeed set a dangerous precedence.

I have applied for H1B transfer and here is my situation.
H1B expiration date with ex employer was 06/10/2010 and I transferred the H1B to a new employer on 06/01/2010 and the approval came on 08/09/2010. However the approval notice says the validity date is from 08/02/2010 to 08/01/2011. It should have been 06/11/2010 because we filed this transfer before the expiration date.
We sent an inquiry but the officer was saying the application was submitted based on new employment and not continuation of previously approved employment without change with the same employer, so we will not change our decision.
What should I do? I think I was out of status from 06/11 to 08/01. Does anyone have any information?

I am applying 485 for me and my wife.My wife got H1 in Oct 2006 but she didnt work until now So she dont have any paystubs.So my attroney suggested to do it on H4 but her H1 is to be collapsed for that she is planning to go canada (not for stamping)and come back so that her H 1 will be collapsed and H4 will be there.I came to know from my friends that canada people are not givng any I 94 for visitors who travle by road.If we request for I 94 they are asking to keep the same I 94 which we have in our respective document.I just want to know how to get the new I 94 for her?
And also Please suggest If there is any way to apply for 485 without cancelling her H1.

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?

All,
I had posted some queries previously and thanks to all who took time to respond.
As I had said before , I have an admission to study for my MBA outside US for one year. Here is the latest update:
I was thinking I will get a one year leave abscence from my employer ( advt on the website), but apparently they dont support studies as part of the deal.
So i am out of luck;
Considering my situation what do you gurus recommend.
How can I leave US yet maintain my GC process.
My I-140 is approved
Situation:
Spouse in school Full time Studies on I-485 pending. ( entered on F1 then converted to I485..... so going back to F1 is impossible)..
I want her status to be preserved.
My thought:
Resign from my company when I need to leave. Convince them that I will return. Maintain no ties with the company for one year..basically can be compared to being jobless for one year.
and then get a letter that a future similar job will be available with the same Co. ( that sponsored my GC)...
Is this feasible ./practical?

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. If you are born in UK and if you apply for labor certification under EB-2 category (job requirement: Master's degree or BS+5 yrs exp) then your priority dates are current and you can file for I-485 and get your GC in about 1.5 yrs...(ofcourse only if its not stuck under name check or any other complications...)

Its true that you have to have valid passport (which is not expiring withing 6 monts) at the time of visa stamping.
Get a new passport before you leave for India. You can apply for a new passport in India Consulates in USA. Google it and you will find out more.
