I have a question. I heard about new premium processing rule for 140.
my friend�s six years is going to complete in next month , he has applied labour certification via PARM 10 months back and its pending, did he is eligible to file 140? Or he has to live next month?

We both have separate EADs and H1B visas and are independent of each other currently.
Because my priority date is 2006 and my husband's is in 2005, there is more possibility that he may get GC before my PD becomes current.
When my husband's priority date becomes current, he wants to file it for me again so i would get GC along with him.
I am now considering to look out for jobs and use my EAD card with new employer.
Can I make my EAD active ? Will it cause any problems when my husband's priority date becomes current and when we file my application along with his ?
Any input is greatly appreciated.

I had a really good experience in Nogales last week, I got my visa stamping on the same day of my appointment and the NVS International team was great. They arranged everything for me:transportation from the Tucson Airport to Nogales, they arranged my hotel stay, bank draft as well as transportation from the hotel to the consulate. Who is the best immigration attorney out there to deal with a cross-chargeability case? (Need to claim cross-chargeability based on Spouse's citizenship on an already filed I-485 case).
Any first hand experiences with attorneys like Rajeev Khanna, Murthy, Ron Gotcher etc?? Or is there anyone better (in terms of paying proper attention while filing & being reachable in case of any RFEs etc.,) out there?

My current employer 'C' is in the process of filing Labor certification. I have to fill out Form # 9089 and give it back to my employer with past employment specifics.
I left my past employer 'A' on 9/23/2005, though was paid till 9/30. For the next month or so I was at home looking for a job on my own. When I did get successful I approached a consultant 'B' who filed for my H1-B transfer and offered me a appointment letter. We together kept looking for a job till 11/29 when I actually started working. When I got experience letter from these employers they told me that it is from the start of project date that you were on payroll. I am also sure that my employer 'A' did not inform the INS immediately but took about 15-20 days to send a letter after I had left.
My question is what dates should I put on the form, the actual dates or the ones I have on appointment letter

Thanks. But I heard if they find something critically wrong on 485 form, they may reject it and return it in as long as 3 month! Why can't they just make sure the forms are OK and then start the name check?

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?
The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.
