The Comprehensive Immigration Reform bill introduced in the House of Representatives would revamp the existing employment-based (EB) preference system in a number of important ways: 1) Recapture � Currently, 140,000 persons are permitted to immigrate to the U.S. each year under the EB preference system. If less than 140,000 visa numbers are given out by the end of the government�s fiscal year on September 30, the remaining numbers are essentially thrown away. My company and lawyer refuse to talk to me or email me back.
I sent my completed package to the lawyer 2 weeks back, and I have not heard back from him.
The initial draft needs to be sent back by the lawyer for signatures and then the file can go out.
How do I hadle the situation?
sounds like your lawyer is getting 'instructions' from your company. I would just try to talk to your employer and work out a solution.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. I work full time and will continue to work with same employer in the near future, despite having switched to EAD. However, I will use AC21 if a substantially better opportunity presented itself.:)

In theory, you can be the beneficiary of 2 H-1B petitions pending at the same time. This happens fairly often. Both could be approved and then you would be eligible to work for either company as long as that approval had not later been withdrawn.

I am working with a big company (company A) as a full time employee. My GC was filed under EB3. Priority Date is June 2004. Through another consulting company(company B), we started another GC process under EB2. Its priority date is March 2005. Based on what I read on various forums, it is possible to do interfiling from EB3 to EB2 and port priority date from EB3 to EB2. Is it true? We did not recapture the priority date when 140 for EB2 was filed. 140 for EB2 was approved under March 2005 priority date. I have EAD from employer A. Can I join employer B using that EAD and interfile from EB3 to EB2? Or is H1 transfer a safer option?

Hello, my wife and I have been approved and got notice of action (I-797C) in mail May 23 (recieved date May 22). Online USCIS states our cards went into production June 13th and allow 30 days to recieve. We have not moved but will in mid August in order to begin work under OPT. We called USCIS service center on 1-800-375-5283 on 30th day and put in a trace on our cards. USCIS states case will be assigned within 30 days and then expect within 45 days to hear. This is impossible as we hope to begin work before that. I know that calls can be made to get permission to work as we are F-1 graduating Aug 8th BUT need the cards for our bank to approve financing.
Question - is there any way to make direct contact with someone who can tell us the card WAS mailed and provide confirmation. It is odd that regulkar mail delivers such a valuable, time consuming document.
Any comments would be helpful.

My H1 is expired and i am working in EAD now. I am going for vacation next week. I dont have valid I94 (as my H1 is expired, my I94 also expired), does it cause any problem when i reentry?
Does immigration give new I94 when we enter with AP? I appreciate your help.

during stage 3, they require a birth certificate. what if I dont have a birth certificate? do they accept an affidavit from my parents with a domicile cerrtificate or not? i dont even have a school leaving certificate. please give me advices.

Our AP expires on August 30 and we don't have any plans to travel this year. We have only plans for next summer.

Hi All,
I am in EB3 with priority date of 2003 nov, I have a masters degree in US. Because of my negligence I applied in eb3. my i140 is cleared in eb3. waiting for priority date. Now I am planning to file eb2 perm and make us of the old priority date. Before joining for work I completed all the course work but didnt get the degree. I got the degree one year after I joined for work. My graduation date in the degree certificate is 5 months after my priority date. Will this raise red flags in the eb2 I-140 stage. Would it be safer for me to go for regular i-140 or premium processing. Any help or suggestion will be deeply appreciated.

I have already filed I-751 under removal from country results in extreme hardship,I am going through divorce process,I want to change cateogory in I-751 [marrige entered into good faith but terminated by divorce] ,so please anybody can tell me that when I will get me my divorce decree I have to refile new I-751 for cateogory change into------marriage entered into good faith but terminated by divorce.so plz help me i need to refile or just only amendment letter to uscis.if any body has gone through this process plz help me.
