I am currently on H1B with a temp status (B1) and in-between jobs. My partner is in the process of becoming a US citizen. He has had his Green Card for years and obtained it through his ex-spouse's job while they were still married. He has been divorced for about a year now and started the citizenship application process a couple of months ago. We are thinking of getting married after he gets his citizenship. My question is: does it matter if we get married before or after he obtains his citizenship? We heard rumors that a previous marriage might be a factor in whether I will be able to obtain a Green Card. Thank you very much in advance for your help!

One think people don't get is, whether the current/future job qualify for EB2, It doesn't matter even you have a Phd and the job only requires Bachelor or equivalent then it is EB3, also certain programming jobs doesn't qualify for EB2. First ask your HR for min job requirement!:(

A little out of the box thinking. There are some useful ideas here even if there are many practical questions on how the plan would work. For one, is a highest bidder system necessarily the best indicator of which employers are most deserving of securing visas. Should a school system desperate for math teachers lose out on securing a visa just because it has a much more limited budget than a major corporation? I'd suggest perhaps looking at a program like this running as a separate track in the immigration system rather than necessarily replacing what we have. Of course,...

Dear Sir/Madam,
I would really appreciate if you can help on the question below.
1) My wife changed her last name after our wedding.
2) She got it updated on new passport, I-20 and SSN.
Now, we are planning to travel to India. She has her old as well as new passport .. and the F1 visa and I-94 is still at the old passport.
My question is: Does she need to get her F1 stamped again in order to get the updated name on her new passport?
I would greatly appreciate your fast response.

I can tell you from my past dot com bust experience, getting companies to file for GC had become very tough. Getting labor certification cleared was even a bigger challenge. I can say, when economy goes south, immigrant's life gets tougher. Hope for the best, prepare for the worst.

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..

I am guessing it should be OK. if at all it needs redirection they will do it internally. besides you can check in your online case status about the RFE or call NSC if you need.
