-One highly-skilled professional's package, hand-delivered by employer's attorney on July 2, monday morning to USCIS (NSC) was apparently not accepted
- One would expect that they open the package and send it back with a letter stating a reason for refusal
- What evidence can an applicant present in such a situation that his package was attempted to be delivered? (no fedex tracking number or other such reference).

Hi Friends,

I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.

1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.

2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?

3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.

It'll really helpful to decide based on the folks replies. Thanks alot for the help.

Hello,
I am on an O-1 visa married to a G-4 visa holder working for an international organization. My spouse's work told her recently that her spouse and other dependents have to be on a G-4 dependent visa unless they are a US citizen, green card holder or on their own G-4 visa.

1. If I change to G-4 spouse visa, I would have to wait 4-6 weeks before I get an EAD to work. So, I want to know if this is indeed true.
2. Can I continue to work on my O-1 until I get the EAD? Is there any way to expedite the EAD process.
3. Plus, I want to know about the portability of the EAD I can get through a G-4 visa.
4. Also, would this restrict my ability to apply for a green card in the future.

if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

Disclaimer: I'm not an immigration attroney, so please check with one for your situations as laws/procedures are changing frequently.

I have a question on filling up this form

It asks for Alien Registration Number (In section 5) - can anyone tell me what to fill this up with, since I do not have Green card?

There is a slot for I-94 admissions# which I have filled up.

Any help will be appreciated.

I was on H1B until Feb 2009 and I applied for COS to H4 in Feb 2009. USCIS has received my COS application, and it is still pending with USCIS for 2 months now.

1. Can a new employer apply for a new cap-exempt H1B for me (technically a transfer, as I was on H1B for 2 years before)?
2. In that case, do I need to submit paystubs and W2s from when I last held H1B status?

I m not sure but I think he has to wait till he gets his citizenship . The other way to apply for Tourist or student visa. Tourist visa will be for short time and student visa will be hard to get if the Husband is Green Card holder.
Again, I m not 100% sure of this. some experienced people may be able to give you detailed information

Guys, I need ur suggestion and experiences on my typical situation

I am in the process of going full time with my client.

I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.

my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.

My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.

Was anybody in a similar situation ?

I don't want to take a risk by using EAD and my wife loosing H4 status.

Please advice

my current employer filed for my labor in march 2005, got approved in march 2007, filed I-140 in April 2005,and while I-140 was pending filed I-485 in july fiasco. In sep-2007 got intent to deny of I-140 based on A2P(ability to pay), employer filed M.T.R in October 2007. I have my fingered crossed looking at the financial statment from employer for the year 2005. chances are the MTR will be denied too. Now I have a new job offer from another employer who is willing to do new H1b for me and may be a labor petition too. the question is I want to see what comes out of the current MTR. Here is the question;
1/- if I tell the current employer to contine the process(which I dont think he will have problem with) and join the job on h1b will my I-485 status be changed or will it effects the current process?
2/- I am currently runnig on sixth year of h1b and my current visa expires in 2010 bades on the pending process with current employer. if I join the new employer on h1b what will be the H1b status will be?

I'm a July 2nd eb3 filer. Never thougt I could file 485 on July just like many people. I started an eb2 Perm early this year with a new position same company. A month later after filed eb3 based 485, my Eb2 Perm got approved, then filed eb2 140.

The problem is my eb2 LC and pending 140 says that I'm holding a position. What can I do? should I withdraw eb2 140? Can I still take advantage of the pending eb2 140, or better leave it along?

Hi Immigration Voice Team,

I would like to know your advice,

My details are

- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010

I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.

As of now

- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.
